1. General

These Terms and Conditions (“Terms”) govern the use of the LanguageLeveler application (“App”) and any related services, materials, or functionalities provided by or on behalf of LanguageLeveler (“we,” “us,” or “our”). By accessing or using our App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our App.

2. Applicability

These Terms apply to all users of the App, including registered and unregistered users. Additional or separate terms may apply to specific services or functionalities within the App. If there is a conflict between these Terms and any other applicable terms, the latter will prevail with respect to the conflicting subject matter.

3. User Obligations

  1. Compliance: You agree to comply with all applicable laws and regulations when using our App.
  2. Account Security: If you create an account, you are responsible for keeping your login credentials confidential and secure. You agree to notify us immediately of any unauthorized use of your account.
  3. Accuracy of Information: You guarantee that any information you provide to us is accurate, complete, and up to date.
  4. Prohibited Conduct: You will not:
    • Use the App in any unlawful manner or in a way that could harm or disrupt our systems;
    • Engage in any activity that violates the rights of third parties, including intellectual property rights;
    • Transmit any viruses, malware, or other harmful code.

4. Intellectual Property

All content, features, and functionalities (such as text, graphics, logos, icons, images, and audio clips) available through the App are owned by or licensed to LanguageLeveler and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or publicly display any part of our App without our express written permission, except where such use is permitted by law.

5. Fees and Payment (If Applicable)

We may offer certain premium features or services within the App that require payment. If you choose to purchase such features, you agree to pay all applicable fees. We reserve the right to change our pricing structure at any time. Any changes to fees will be communicated in a timely manner and will not affect previously purchased services or subscriptions until the next renewal.

6. Availability and Changes to the App

We strive to ensure that the App is available and functions properly at all times, but we do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the App at any time for maintenance, improvements, or other reasons without prior notice.

7. Warranty Disclaimer

The App is provided “as is” and “as available” without any explicit or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we make reasonable efforts to provide accurate and reliable information, we do not warrant that the App will be error-free, secure, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by Dutch law, LanguageLeveler and its affiliates, licensors, and service providers are not liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of, or inability to use, the App. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the minimum extent required by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless LanguageLeveler, its officers, directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney fees and costs) arising out of or in any way connected with your breach of these Terms or your use of the App.

10. Privacy

We value your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

11. Termination

We may, at our sole discretion, suspend or terminate your access to the App at any time if you violate these Terms or if we believe it is necessary to protect our legitimate interests, comply with legal obligations, or maintain security.

12. Governing Law and Dispute Resolution

These Terms and any disputes relating to them or the App are governed by and construed in accordance with Dutch law. Any disputes arising out of or in connection with these Terms will be submitted to the competent court in the district where LanguageLeveler is established, unless mandatory law provides otherwise.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will become effective upon posting the updated Terms in the App or on our website. We will notify you of any material changes. By continuing to use the App after such changes, you agree to the updated Terms.

14. Miscellaneous

  • Entire Agreement: These Terms and any other legal notices or policies we publish via the App or on our website constitute the entire agreement between you and us regarding the App.
  • Severability: If any provision of these Terms is deemed unenforceable or invalid under applicable law, the remaining provisions remain in full force and effect.
  • Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations to a third party in the event of a merger, acquisition, or sale of assets.
